General
These general terms and conditions govern the use of the sales site of DRIES BUSSELOT, trading under the commercial name SLOW Running, with company number 0899.663.815 and registered office at Roeselarestraat 174, 8560 Wevelgem (hereinafter referred to as "the seller"). Furthermore, these general terms and conditions also apply whenever an online order is placed via the website of SLOW Running via www.slow-running.eu (hereinafter referred to as "the website").
The website is created and managed by the seller. Users of the website (hereinafter referred to as "users") may view and print the information on the screen of the website free of charge for personal use, but not for commercial purposes. Anyone who places an order on the website (hereinafter referred to as "the customer") confirms by placing the order that they are a natural person and are also legally capable.
Legally incapable persons must be represented by their legal representative who is also bound by these sales conditions and must fill in the order form themselves or grant explicit permission for the legally incapable person to do so. The provisions of the following article ‘protection of privacy’ regarding the processing of personal data shall remain fully applicable.
Placing the order entails a payment obligation. Placing an order on the website constitutes explicit acceptance of these general sales conditions, which are published on the website and sent along with the order confirmation. Acceptance of the general conditions is necessary for placing an order. Anyone who orders declares to know and accept the seller's general conditions. The general conditions are always available and consultable via the website. For each order, the general conditions that were included on the website and order confirmation at that moment apply, excluding any older or newer provisions. If one of these conditions is invalid for any reason, the remaining conditions shall remain in full force.
What is not explicitly stated in these sales conditions is governed by the provisions of Belgian law. The language of the concluded agreements is Dutch. Contact can always be made with customer service via the contact form or via e-mail in case of ambiguity.
Offer and order
An order can only be placed via www.slow-running.eu.
The seller commits to processing the orders placed on the site as long as stocks last and within the limitations formulated in these terms. The online order can only be processed if the customer has clearly identified themselves. Within 2 days after the seller has received the user's order, the seller will send a confirmation email to the email address provided by the user, stating the correct order number. This email also contains a summary of the order and a link to the downloadable General Terms and Conditions.
The seller reserves the right to refuse orders in the event of serious suspicion of abuse of rights or bad faith, serious suspicion of unacceptable commercial purposes for the seller, or in the event of exhaustion of stock of a particular item.
An order is only final after acceptance of these general sales conditions, the prices, and the description of the offer. If anything in the offer or after ordering is insufficiently clear, the customer can always contact the online customer service for additional information via the contact form under the section 'contact us', via email or by phone. All questions will be answered as quickly as possible.
The user must also select the desired payment method when placing the online order, as well as the desired place of delivery/collection.
Offer
SLOW Running offers (running) shoes, clothing, and accessories.
Despite the fact that the online catalogue and the e-commerce website are compiled with the utmost care, it is still possible that the information provided is incomplete, contains material errors, or is not up to date. Obvious mistakes or errors in the offer do not bind SLOW Running. SLOW Running is only obliged to the accuracy and completeness of the information provided to a best-efforts commitment. SLOW Running is in no case liable in the event of material errors, typographical or printing errors.
If the customer has specific questions about the offer, availability, delivery time or delivery method, we ask the customer to contact our customer service via email or by phone, or to visit our store (Kortrijkstraat 23, 8560 Wevelgem).
The offer is valid as long as stocks last and can always be withdrawn or changed by SLOW Running. The seller cannot be held liable if a product is not available. In the event that an order placed is not available, for whatever reason, the customer will be contacted and a refund will be provided.
The products offered by SLOW Running are manufactured by the original manufacturer.
Payment
The prices are those stated on the website at the time of the order. All prices include VAT. However, the seller has the right to adjust the prices listed on the website if circumstances beyond their control cause the cost price of the products to rise, such as in the case of an increase in supplier costs, wage increases, social charges, transport costs, etc. In the event of incorrect price reporting due to a technical error, the seller has the right to cancel the order.
Payment must precede delivery and is made via one of the following payment options: Bancontact, Visa, MasterCard, Payconiq, Apple Pay. Payment can also be made with vouchers (gift vouchers, discount vouchers, credit vouchers…).
For delivery within Belgium, the prices include delivery costs, except for purchases under €100 (€7.50 delivery). If you have your package delivered to the Netherlands, France, Germany, Luxembourg, Spain or Italy, the delivery cost is €10 for orders under €100. Delivery outside these countries is generally not possible. If this is still desired, please contact us via e-mail or telephone and then we can look into the possibilities.
Delivery
Delivery is currently only possible in the following countries: Belgium, the Netherlands, France, Germany, Luxembourg, Spain and Italy. In special cases, delivery can also be made outside these countries, but this must always be arranged via e-mail or telephone. For deliveries outside Belgium and within Belgium for an amount under €100, please take into account a delivery cost. See "Payment" for more information.
When the customer chooses delivery to an address, post office, collection point or parcel machine of Bpack 24/7, an email is sent at the moment the delivery is handed over to Bpost. Via the link provided with the tracking number, the customer can track the shipment using Bpost's e-tracker. The customer who chooses delivery in-store receives a confirmation email as soon as the order is ready for collection in the store. The customer who chooses delivery to a post office, collection point or parcel machine receives an email or SMS as soon as the shipment has arrived at the chosen collection point.
The user acknowledges being aware that the general terms and conditions of delivery of the seller apply to the shipment of the products and acknowledges accepting them.
The seller undertakes to deliver the products as soon as possible, with a guideline delivery period of a maximum of 30 days agreed upon (in practice approximately 1 to a maximum of 5 working days). However, the parties accept that the delivery period may be longer than the aforementioned guideline period due to exceptional circumstances.
If the delivery period of 30 days is exceeded, the user can cancel their order free of charge and the amount paid will be refunded.
Right of withdrawal
Cooling-off period and withdrawal
In accordance with Articles VI 47-52 of the Economic Law Code, the consumer has a period of 14 calendar days to withdraw from the agreement without giving any reason. This period starts the day after the customer has physically taken possession of the product.
To exercise the right of withdrawal, the customer must inform the seller of their decision to withdraw from the agreement via an unambiguous statement. This can be done, among other ways, via the website, via email or by phone.
The customer will be refunded the total amount of the returned items.
Method of returning and time frame
After the notification of withdrawal, the customer has a period of 14 calendar days to return or hand over the goods. This can be done in two ways:
- By post: The item must be packed in a closed box and sent together with the return form (see attachment 1) to the following return address: Kortrijkstraat 23, 8560 Wevelgem.
- In the store: The item can be returned free of charge at our physical store at Kortrijkstraat 23, 8560 Wevelgem. The item must be returned in its original packaging.
Costs of return and shipping
If the customer exercises the right of withdrawal, the direct costs of returning the goods are entirely the responsibility of the customer. These costs will be deducted from the refund. When returned in the store, the return is free of charge.
- For returns by post: The seller will provide the consumer with a shipping label via email after the return request. The exact cost of this shipping label will be deducted from the refund.
- For returns in the store: The return is completely free of charge.
Partial withdrawal and shipping costs:
If the customer places an order that qualifies for free shipping (because the order amount exceeds a predetermined threshold) and then decides to revoke only part of the order, the following conditions apply:
- If the total purchase amount of the remaining (non-returned) items from that same order falls below the threshold for free shipping after processing the return, the right to free shipping for that order is forfeited.
- In that case, the seller reserves the right to deduct the regular shipping costs for the outbound shipment (according to the rates applicable at that time) from the amount to be refunded to the customer for the returned items.
Refund
The seller will refund all payments received from the customer for the returned items (taking into account any adjustments for shipping costs as mentioned in point 3). If the customer revokes the full order, the original outbound shipping costs (excluding any additional costs resulting from a more expensive delivery method chosen by the customer than the standard delivery) will also be refunded.
The refund will be made using the same payment method that the customer used for the original transaction, unless the consumer has expressly agreed to a different payment method (such as a voucher). The seller may wait to process the refund until the goods have been received back. The refund will occur within 30 calendar days after receiving the items at the return address.
Obligations of the consumer during the reflection period
The customer must handle the product and packaging carefully during the reflection period. The principle here is that the customer may only handle and inspect the product as they would be allowed to do in a physical store.
The customer is liable for any depreciation of the goods resulting from handling or using the goods that goes beyond what is necessary to establish the nature, characteristics, and functioning of the goods.
If an item is returned damaged, incomplete, worn, washed, or without the original packaging/labels, the seller reserves the right to deduct this depreciation (which can amount to 100% of the purchase price) from the refund.
Warranty
All products come with a 2-year warranty from the delivery of the products. The parties accept that the nature of the products cannot justify a legal presumption that defects in conformity are presumed to have existed at the time of delivery (in the sense of art. 1649quater, §4 B.W.). Defects caused by accidents, negligence, or improper use (by the user themselves or by third parties) are not covered by the warranty and are therefore not considered a lack of conformity.
The claim for warranty must be made by bringing the products (which must be dry, hygienic, and clean) to the store or by returning the products by the user together with the proof of purchase to the following return address: Kortrijkstraat 23, 8560 Wevelgem. The return must always be agreed upon first via e-mail, by phone or after a visit to the store.
There will always be a request for proof via photos (via email) or after inspection in the shop, before the warranty will be processed.
In case of reported issues outside of normal wear and tear resulting from normal use, contact can also always be made, either via email, or by phone or by visiting the shop. A solution will then be sought together. If the delivery needs to be returned to the seller, this will be done in the manner specified under art. ‘Right of Withdrawal’. The shipping costs in case of warranty are borne by the seller.
The seller provides the guarantees provided for by law.
The seller is not liable for force majeure, accidents, misuse or incorrect handling of an item by the customer.
An item with an accepted defect will be replaced or repaired free of charge. If the repair costs are disproportionate, the seller reserves the right to replace the item or to exchange it for a similar item.
Gift vouchers
The user can purchase gift vouchers online. These gift vouchers can be used for the purchase of products in the SLOW Running or on the website.
Signature and proof
The customer is solely and exclusively responsible for the accuracy of the information they provide.
For a first online order or reservation, the customer must follow the registration procedure. After this, the customer only needs to log back in to place a new order or reservation.
The final confirmation of the order by the customer constitutes acceptance of the order at the stated price. The customer's confirmation serves as a signature and explicit acceptance of all transactions via the website.
Privacy protection
By placing an order, the customer declares to have taken note of the seller's privacy policy. The seller's privacy policy contains the necessary information on how and for what purposes personal data is processed and which cookies are used.
The user has the right at all times to view, modify, and have that data deleted if they no longer wish to receive information about our activities. For this, they can contact the seller's customer service in writing. The customer can modify their data via their account profile.
Liability for website use
The seller's website is intended to provide general information to the customer about the seller's products and activities. The seller has only an obligation of effort regarding access, the ordering process, delivery, or other services.
The seller has the right to suspend or terminate the site in whole or in part at any time for maintenance, updating, or any other reason, even without prior notice.
The seller cannot be held liable for any inconvenience or damage caused by the use of the internet, by any system failure, the intrusion of outsiders or a virus, nor for any information placed or processed by third parties or for any event that can be considered as force majeure.
Intellectual property
All components of the seller's website, both the visual elements and the audio elements, including the technology used for them, are protected by copyrights, trademarks or patents or more generally by intellectual property law. They are the exclusive property of the seller.
Users who have their own website on the internet and who, even for purely personal use, wish to set up an automatic link between their own site and the seller's homepage, must explicitly request permission from the Seller.
Jurisdiction and applicable law
Only Belgian law applies to these general terms and the legal consequences arising therefrom. All disputes that may arise from these general terms fall under the exclusive jurisdiction of the judicial district of Kortrijk, regardless of the method of payment or delivery. The parties accept that Kortrijk is the place where the obligations arising from the delivery by the Seller to the User arise, in the sense of art. 624, 2° Ger.W..
